Gardastays publishes the terms and conditions provided by each property owner listed on the website gardastays.com. Below are the general points governing booking and stay terms.

1. Acceptance of General Conditions

These general conditions must be accepted by the guest before key handover. Signing the booking contract or confirming the booking via email or OTA platform constitutes full acceptance. Check-in will not be possible without this acceptance.

2. Booking Deposit

Sending a payment does not automatically constitute a binding reservation. A booking is confirmed only upon receipt of a confirmation voucher from Gardastays or the property owner.

The deposit amount varies according to the individual owner's policy. The balance must be paid within the terms indicated in the booking conditions, and in any case before key delivery.

3. Costs and Services Included in the Rental Price

The price includes exclusive use of the furnished property and its appurtenances. Included:

• Water and gas consumption
• Electricity usage up to 200 kWh/week, unless otherwise stated

Also included in the total price:

• Final cleaning
• Bed linen and towels

Gardastays cannot offer additional cleaning or optional services upon request.

4. Cancellation Policy

Gardastays applies the cancellation policy defined by the property owner and outlined in the booking contract.

In case of cancellation, Gardastays commits to mediate with the owner to obtain the best possible outcome for the guest.

5. Security Deposit

A security deposit is required before check-in as a guarantee against potential damages to the property. The amount will be specified in the booking contract.

The deposit will be refunded at the end of the stay after inspection by staff or the owner.

Damage not immediately verifiable may delay refund up to 30 days.

6. Number of Guests

The maximum number of guests is the one stated in the reservation. Exceptions are only made for children under 2 years of age.

If the limit is exceeded, Gardastays or the owner may cancel the booking and retain the security deposit.

7. Property Access

Gardastays, the owner, or authorized representatives may access the property at reasonable hours for maintenance or emergencies (e.g., breakdowns).

8. Guest Responsibilities

The guest is required to:

• Keep the property, furniture, and equipment in good condition
• Not leave garbage inside the property at check-out (otherwise €50 will be charged)
• Avoid damaging structures or systems (any damage will be deducted from the deposit)

Parties or events are prohibited unless explicitly authorized in writing by the owner or Gardastays.

Installing external sound systems is forbidden, and outdoor music after midnight is not allowed, in compliance with local laws.

Formal complaints or intervention by authorities may result in loss of the deposit and early termination of the stay.

9. Liability Limitations

The guest is not liable for failures of general systems (e.g., water pump, electricity, pool), but must report them promptly.

Gardastays is not liable for personal injuries or damages unless due to proven negligence by the property owner.

10. Security and Valuables

Valuables left in the accommodation are under the guest's responsibility. Gardastays is not liable for theft or damage to personal belongings.

In case of theft, the guest must notify Gardastays or the owner promptly. Gardastays is not responsible for losses due to criminal acts or lack of security.

11. Payments and Refunds

The website gardastays.com is an online showcase managed by Gardastays by Michele Cobelli, based on the Lodgify platform. This allows guests to make payments directly to the property owner, without any mediation from Gardastays.

Payments can be made via:

• Credit/debit card (e.g., Stripe)
• PayPal
• Bank transfer directly to the owner

Gardastays does not collect, manage, or transfer funds, and is not responsible for the financial management of bookings. The guest enters into a direct agreement with the property owner, who is the merchant of record and sole recipient of the payment.

Gardastays is not a payment intermediary nor a collection platform, and is not required to apply withholdings or issue tax receipts on behalf of owners.

In case of refund requests or cancellations, Gardastays will assist in communication with the owner to facilitate the process according to the cancellation policy of each property.
