Gardastays by Michele Cobelli acts exclusively as a Property Manager with representation, supporting property owners in the operational management of tourist rentals. It is important to note that:
The properties listed on gardastays.com are rented exclusively for tourist purposes and for periods of less than 30 days. Therefore, registration of the contract with the Revenue Agency is not required. The rental is for non-residential purposes and does not constitute domicile.
These general conditions, together with the specific property rules, must be fully accepted by the guest. Signing or submitting the online Check-in form constitutes full legal acceptance of the tourist rental contract and these conditions.
Unless specifically stated otherwise in the booking confirmation, standard times are:
The gardastays.com website acts as an online showcase. The payment system (based on platforms such as Lodgify/Stripe/PayPal) allows the guest to pay directly to the property owner.
Funds Management: Gardastays does not collect, hold, or transfer funds.
Merchant of Record: The owner is the sole recipient of the payment (Merchant of Record) and responsible for issuing any receipts or invoices.
Confirmation: The booking is considered confirmed only upon receipt of the confirmation voucher. The balance must be paid before key handover according to the indicated terms.
The rental price includes the exclusive use of the property and its appurtenances. Included in the price (unless exceptions are noted in the property listing):
Gardastays does not provide extra cleaning services or linen changes during the stay, nor personal or hotel-type services.
A security deposit is required to guarantee against any damages or rule violations.
Refund: The deposit will be released/refunded within 30 days of check-out, subject to property verification by Gardastays (on behalf of the owner).
Compensation Obligation: In the event that the security deposit has not been paid or is insufficient to cover damages, the guest, by accepting the contract via the check-in form, formally agrees to reimburse the owner for the full amount of the damage caused.
Non-Payment: In case of non-reimbursement, the owner may take legal action at the competent court (where the property is located).
The guest is required to take care of the property with due diligence ("bonos pater familias").
Gardastays, the owner, or authorized technicians have the right to access the property at reasonable times for urgent maintenance, necessary inspections, or emergencies.
The cancellation policy defined by the owner and stated in the booking voucher applies. Gardastays assists in communication between parties regarding cancellations or refund requests but has no autonomous decision-making power over funds, which remain with the owner.
Systems: The guest is not responsible for accidental breakdowns of systems (e.g., boiler, pool) but must report them promptly.
Security: Gardastays and the owner are not responsible for theft, loss of unattended valuables, or damage to persons/property resulting from guest negligence or illicit acts by third parties.
Guest personal data is processed in compliance with GDPR for purposes related to stay management and legal obligations (including reporting to the "Alloggiati Web" portal of the State Police).
